Our team at Paradise Rental Retreats, INC is looking forward to having you as our guest! Please review this Rental Agreement ("Agreement") in its entirety. It will govern your rental arrangement and legally binds you ("customer") to the terms set forth below. This rental is conditioned expressly upon your acceptance without modification of the terms, conditions, and notice requirements set forth below. By Signing below, I AGREE TO THE TERMS AND SUBMIT PAYMENT, CONSTITUTES YOUR AGREEMENT TO ALL SUCH TERMS, CONDITIONS AND NOTICE REQUIREMENTS, INCLUDING THE CANCELLATION & REFUND POLICY. Once your credit card is successfully charged or your other form of payment is timely received, we will issue you a confirmation notice.
1) ACCEPTANCE & PAYMENT TERMS
This agreement must be signed/dated and your required payment must be received in a timely fashion (either the deposit or full payment) for your reservation to be confirmed. Please make your required payment of 50%, if your reservation is more than 30 days in the future, or the full balance if it falls within 30 days. By authorizing payment via credit card you are authorizing, Paradise Rental Retreats, LLC acting as an intermediary between you and the HOME OWNERS, to charge your credit card the balance of the total charges 30 days prior to the commencement date of your rental period. If you book your rental less than 30 days in advance of your stay, we will charge your full payment immediately by credit card or you must otherwise arrange for payment immediately or your reservation will not be accepted. If a balance payment is to be made, a confirmation notice will be sent to you via email to confirm receipt of payment.
FAILURE TO MAKE FINAL PAYMENT ON A TIMELY BASIS MAY RESULT IN CANCELLATION OF YOUR RESERVATION AND LOSS OF ANY DEPOSIT PAID PURSUANT TO THIS AGREEMENT'S CANCELLATION AND REFUND POLICY.
Until payment is received, the house remains available for other customers to rent. If you made arrangements to wire transfer or mail a check, we will hold the reservation for 3 business days. If the required payment and your acceptance of this Agreement are not received to the address above on or before 5:00 PM of the 3rd business day following the "Date Agreement Issued" indicated above, your reservation will be automatically cancelled. Once your signed agreement and your deposit or full rental fee are received, a confirmation notice will be emailed to you.
2) CHECK IN & CHECK OUT PROCEDURE:
Check-in begins at 4:00 p.m. Please inquire about earlier check in times a few weeks prior to your arrival. We do encourage you to visit our many outside restaurants and attractions, if you should arrive earlier.
On occasion, we may require extra time for cleaning or maintenance, which may delay check-in. Keys or door codes may be released at 4:00 p.m. we do not guarantee properties will be ready by 4:00 p.m. However, we will do our best and we do realize this is your vacation. This makes it of the utmost importance that our guests check-out on time, promptly at 11:00 a.m. All of our vacation rental homes are cleaned before your arrival and after your departure, however ask about a mid-stay cleaning or daily maid service for an extra charge.
Please note: If you would like to request an early check in or late check-out, please do so in writing and have a written confirmation of approval. We absolutely try to accommodate our guests, if our vacation home rental is available.
Please note-if your check in or check-out is delayed a waiting fee of $25/hr. will be charged to your credit card for our crew after 20 minutes.
Upon Check Out:
We do ask that you please leave our vacation rental home in the manner that you have received it. Below is a short list of items we ask you to do upon exiting our vacation home rental. This will help to ensure our cleaners will be able to have our vacation rental home prepared in time for our next guests that may be checking in.
Strip all beds and bathrooms of used linens, towels, beach towels, and kitchen towels and place all dirty laundry on the floor in the kitchen.
Clean all dirty dishes in house and put away in cabinets (none left in dishwasher or drain rack).
Clean off grill of BBQ with wire brush provided.
Remove trash from all trashcans in house (bedrooms, bathrooms and kitchen) and place in large outdoor trashcans. (Please make sure all trash has been put out on proper trash removal dates. If trash pickup is the next day, place containers by the curb). Excessive garbage removal may result in a $50.00 trash removal fee.
Close all windows turn out lights, fans, and air conditioning turned to 80 degrees.
If furniture has been moved, please put back into original location it was when you arrived.
Place remote controls on top of televisions.
3) INSURANCE
It is strongly recommended that customers purchase travel insurance. You are a valued Customer and we want to do everything possible to make your trip enjoyable and worry free. Because the unforeseen and unexpected can occur before you leave or when you are away from home, we recommend TRAVEL GUARD’S Cancellation Insurance Plan. For more information on what this insurance covers, please call Michelle Martin, 954-646-0557.
4) CANCELLATION AND REFUND POLICY
Guests must cancel at least 60 days prior to arrival to receive a 50% refund of your deposit. Cancellations less than 60 days prior to arrival, which includes a customer’s decision not to stay at a rental upon arrival will forfeit 100% of the funds paid to date. There is no refund for early departures, bad weather, or late arrivals. Only the guest named on the rental agreement may cancel reservations and it must be in writing or via mail. Paradise Rental Retreats cannot refund any amount of your stay for circumstances outside of our control. Such as, Acts of God, severe weather conditions, failure of public utilities, mechanical or appliance failures, Wi-Fi failures, etc. Reservations may be changed if requested in writing to Paradise Rental Retreats, if in the same pricing period and as per availability of our vacation home rental. Collected money is non-refundable unless rental unit becomes unfit for habitation as deemed by Owner and Agency. Under no circumstances shall customer be able to determine if a rental unit is unfit for habitation.Travel/Cancellation Insurance is recommended.
5) Smoking
All of our vacation rental homes are NON-SMOKING. If we detect that the house has been smoked in during your stay, a $250.00 charge to air out and clean the premises will be charged to your credit card.
6) SECURITY DEPOSITS
We require a security deposit for the protection of the owners and their homes in guests under the age of 25. In lieu of a cash deposit, Paradise Rental Retreats, INC uses a Damage Waiver. In addition, you hereby grant consent for Paradise Rental Retreats, LLC to charge your credit card any amount of actual damages to the Property arising from your use of the Property, as well as for missing items, excessive clean-up, and, if necessary, the cost incurred in removing you from the Property above the amount covered by Damage Protection Policy. The vacation rental home must be left in the exact condition that it was in when the Licensee arrived. Any damage, even if not directly caused by Licensee is the responsibility of the Licensee and shall be covered by the mandatory damage waiver, if not exceeding its coverage in which case it becomes the Licensees responsibility.
7) PETS
Some of our vacation rental homeowners allow pets for an added fee of $200. Additional pets are $100, some owners may limit the amount of pets on premises. All pets must be crated if left unattended at the property and not for time periods of more than 4 hours. Guests are responsible for picking up after their pet during stay and prior to check out. Sorry, no pets are allowed in units that owners do not accept pets. If there is any damage done to the property, guest’s credit card will be charged for the cost to repair/replace any and all damages, resolve any odor and/or flea problems and for any costs incurred to relocate future guests checking in after your departure. If it is found that you have an unapproved pet in your vacation home, all guests will be evicted immediately without refund.
8) EXCESSIVE USE AND MISCONDUCT
All of our vacation rental homes are located in residential communities and most of the neighboring homes are owner occupied. In order to maintain peace within our homeowners and our neighbors we do not allow parties, loud gatherings or events except by special permission. Any use of the vacation rental home property for a purpose other than residential use for a family vacation must be approved in writing by Paradiserentalretreats.com
In addition to the maximum occupancy stated for your vacation rental home, day/evening guests are limited to 6 unless otherwise permitted, in writing, by Paradiserentalretreats.com. All day/evening guests must vacate the vacation rental home by 11:00 p.m. Should you wish to entertain or have more than 6 guests at the vacation rental home, we have a special form to fill out to request permission for your event/gathering. Your request must be received by Paradiserentalretreats.com in writing no less than seven (7) days prior to the day of proposed event. You will need to provide the total number of guests you intend to have on at the vacation home rental, how you will accommodate your guests (inside, outside or both), times additional guests will be at the property, an explanation of activities to take place during the event, i.e. if there will be amplified music, table and chair rentals, if the event will be catered, etc., and any other circumstances that could affect the facility or neighbors of our vacation home rental. Under no circumstances will you be permitted to remove any furniture from the house. At Paradiserentalretreats.com’s discretion, your request may be denied and/or an additional security deposit and event fee may be required. We reserve the right to cancel your rental reservation and occupancy of rental with no refund if you misrepresent your event.
Our vacation rental homes are intended for family vacations, not as event venues. House parties are absolutely 100% prohibited. You certify that you have read carefully the limitations placed on the number of persons permitted to occupy the premises, and agree to abide by such limitations: if not, you and all other occupants will be required to vacate the premises and forfeit all monies paid should a party occur on the property.
Lessee and/or all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit should any of the following occur: A. Occupancy exceeding the sleeping capacity stated in Rental Agreement. B. Use of the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C. Damage to the vacation home rental or to any of the neighboring properties. D. Any other acts which interfere with neighbors' right to quiet enjoyment of their properties. Occupancy and use of the vacation home rental shall not disturb or offend neighbors or residents. E. House parties, keg parties, excessive speeding, excessive noise or disruptive behavior, discharging of Firearms, BB or Pellet Guns, or Fireworks, etc. IF, FOR ANY REASON, LAW ENFORCEMENT IS NOTIFIED DUE TO DISTURBANCES FROM THE VACATION HOME RENTAL OR GROUNDS, THERE WILL BE A MINIMUM $500 CHARGE TO LESSEE’S SECURITY DEPOSIT OR CREDIT CARD. LESSEE AND/OR ALL OCCUPANTS WILL BE REQUIRED TO VACATE PREMISES AND FORFEIT THE RENTAL FEE AND SECURITY DEPOSIT.
9) PROPERTY INSPECTIONS
Paradise Rental Retreats is a local company and we are available if you need us. We make every effort to keep each of our vacation rental properties and its equipment in good working order. We strive to make any repairs as soon as possible. We cannot guarantee A/C's, TV's, appliances, etc. It is impossible to guarantee that all appliances, hot tubs, hot water heaters, fireplaces, etc. will be in working order 100% of the time. We do guarantee to make every effort to correct all deficiencies as soon as possible during normal business hours. Report all maintenance problems to the office at 954-646-0557. Non-emergency maintenance will be handled the next day.
We are unable to address problems unless reported during your stay, and not upon check out. Cable, satellite, telephone, gas, electric and water service are not under the control and cannot be guaranteed by Paradiserentalretreats. Your silence indicates full acceptance of the unit and its condition. There will be no refunds for breakdowns or malfunctions of these or no refunds for electrical, cable or water outages.
All problems, including inadequate cleaning and damage, must be reported in writing to Paradise Rental Retreats, INC within 24 hours of check-in Email is an acceptable form of communication
10) ACCESS TO PREMISES
Paradise Rental Retreats, INC reserves the right to enter premises at any time for the purpose of performing maintenance calls, or to show the property to insurance or bank representatives or city inspectors. We will contact you in advance and schedule such visits with you. We will not enter the property without having obtained your consent, which shall not unreasonably be withheld.
11) DISCLAIMER
Paradise Rental Retreats, INC operates the homes on behalf of the home owners. It may happen from time to time that a vacation rental home becomes unavailable for occupancy last minute.
Such occurrences are beyond our control. We will make every reasonable attempt to find alternate accommodations but shall not be held liable if unsuccessful. The maximum amount we shall refund is the amount we have received. We shall not be responsible for plane fares, increased cost of last minute arrangements, hotels, or more expensive accommodations than what we had agreed to provide to you. Customer understands that there are certain risks inherent to persons and property located adjacent to the ocean or to a golf course. Customer acknowledges that the Owner would not rent this rental unless the customer accepted these conditions and assume these risks.
**** AS A REMEDY FOR VIOLATION OF ANY OF THE STATED CONDITIONS OF RENTAL IN THIS AGREEMENT PARADISE RENTAL RETREATS, INC ACTING AS AN INTERMEDIARY BETWEEN YOU AND THE HOME OWNERS, HAS THE RIGHT, BUT IS NOT LIMITED OR REQUIRED TO, TERMINATE THIS AGREEMENT AND EVICT THE CUSTOMER FROM THE RENTAL WITHOUT ANY REFUND OF COLLECTED MONEY AND MAY KEEP ALL OR WITHOUT ANY REFUND OF COLLECTED MONEY AND MAY KEEP ALL OR ANY PORTION OF THE SECURITY DEPOSIT IF THERE IS DESTRUCTIVE, UNAUTHORIZED OR CRIMINAL ACTIVITY TAKING PLACE.
12) ADDITIONAL DISCLOSURES:
PARADISE RENTAL RETREATS, INC acts only as an intermediary for the owners, suppliers and contractors providing accommodations, transportation and services to customer. Under no circumstances shall PARADISE RENTAL RETREATS, INC, managing agents, owners of rental, and/or their respective employees be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, caused or incurred whether arising in contract, or otherwise in law or equity as a result of rendering of the services or accommodations as described in this Agreement or as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the services or accommodations arranged by PARADISE RENTAL RETREATS, INC.
Additionally, PARADISE RENTAL RETREATS, INC, managing agents, rental owners, and/or their respective employees shall not be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise caused by reason of military actions, acts of God, or by any agents, employees, subcontractors, servants or services as provided or substituted. PARADISE RENTAL RETREATS, INC at all times will act in good faith and use its best efforts when required under this Agreement to substitute with accommodations or services of a type comparable to those contracted. PARADISE RENTAL RETREATS, INC, acting as an intermediary between you and HOME OWNERS, reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or customer services and PARADISE RENTAL RETREATS, INC will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services.
PARADISE RENTAL RETREATS, INC, managing agents, rental owners, and/or their respective employees are not responsible for theft or damage of personal property and no refunds will be given for any such occurrences. Customer and all occupants have been advised not to leave personal articles in locked vehicles, even if in the trunk; to always lock their vehicle; to always secure the rental. If renting mopeds, bicycles or any vehicles, customers are strongly encouraged to arrange for additional insurance, which provides adequate protection in the event of damage or theft arising out of such activities.
Customer understands that PARADISE RENTAL RETREATS, INC acts as an intermediary between the customer and the HOME OWNERS. PARADISE RENTAL RETREATS, INC receives a commission of the value of the Agreement once all other monies are paid by customer.
Therefore, in order to process a reservation all monies are paid immediately to the legal rental owner, other agent or agency, caretaker, Realtor or property manager to secure the reservation. Since funds are paid to third parties PARADISE RENTAL RETREATS, INC cannot warrant that client funds will be recoverable on behalf of the customer in all circumstances. As a result, customer acknowledges that, if all rental monies have been paid, the maximum recourse the customer has against PARADISE RENTAL RETREATS, INC for any alleged breach of this Agreement is the amount of the commission paid or to be paid to PARADISE RENTAL RETREATS, INC. arising out of this Agreement..
13) CHANGES IN ACCOMMODATIONS
The above rental information, while deemed reliable, is not guaranteed. Changes in inventory and or decor occur from time to time and such changes will not void or alter the terms of the rental and is not a valid reason for cancellation. Customer is aware that PARADISE RENTAL RETREATS, INC. acts as an intermediary and this Agreement is provided on behalf of the owner or owner's designee and PARADISE RENTAL RETREATS, INC cannot ensure specific performance of owner. PARADISE RENTAL RETREATS, INC is acting merely as a intermediary and does not own any rental offered and does not exercise control over or have direct supervision of the owners, managers, other agents, or service providers. Accommodations and amenities vary greatly. Please be sure to inquiry about any specific needs your party may have. All of our vacation homes have the following basic items: Sheets, blankets/comforters, pillows, bath towels, wash cloths, hand towels, bath mats, beach towels, all major appliances, toaster, coffee pot, blender, (everyone needs an umbrella drink on vacation) basic pots and pans, dishes, glasses, flatware, television(s) with basic cable, internet, iron & ironing board, fire extinguisher & smoke detectors. Along with a starter supply of toilet paper, paper towels, dish soap, hand soap, laundry soap & fabric softener. The vacation home will include a gas BBQ, with a tank of propane and an outdoor dining area. Please note, on occasion prior guests may have left partial containers of spices, coffee condiments, etc. It is Paradiserentalretreats.com’s policy to leave non-perishable food items for subsequent guests. However, we assume no responsibility for the quality or contents of products left at the vacation home, and your use and/or consumption shall be at you and your guests’ risk(s). We try and provide all of your items that you may need for your stay with us. However we cannot guarantee your rental home will have all of the items or brands your guests are accustomed to having.
